INTERNATIONAL STATEMENT OF CONDEMNATION
AL-RAFIDAIN INTERNATIONAL CENTER FOR JUSTICE AND HUMAN RIGHTS
Al-Rafidain International Center Condemns the Parliamentary Vote Appointing Laith Hadi Saeed Al-Khazali and Calls for an International Investigation into Allegations of Abduction Murder and Enforced Disappearance
Al-Rafidain International Center for Justice and Human Rights expresses its strongest condemnation and denunciation of the Iraqi Parliament’s vote to appoint Laith Hadi Saeed Al-Khazali as Deputy Prime Minister of Iraq despite the serious allegations surrounding his involvement in grave human rights violations and the United States sanctions imposed on him in connection with such violations
The Center emphasizes that appointing individuals facing serious allegations of violations against civilians to senior positions of sovereign authority constitutes a blatant disregard for the rights of victims and the families of abducted and forcibly disappeared persons and undermines public confidence in state institutions and the rule of law
The Center draws attention to serious allegations requiring an independent judicial investigation into the potential responsibility of Laith Al-Khazali for crimes of abduction murder and enforced disappearance allegedly committed during military and security operations in Salah Al-Din and Nineveh Governorates particularly in Samarra and Mosul in addition to violations documented by international organizations in other areas of Iraq
The Center stresses the urgent necessity of examining these allegations and all related evidence and witness testimonies without delay and determining individual criminal responsibility including responsibility arising from ordering inciting participating in or facilitating the commission of crimes whenever supported by legally admissible evidence
INTERNATIONAL LEGAL FRAMEWORK
The Center bases its demands for investigation and accountability on the provisions of the Rome Statute of the International Criminal Court particularly Article 6 concerning the crime of genocide Article 7 concerning crimes against humanity including murder torture persecution and enforced disappearance Article 8 concerning war crimes and Article 9 concerning the Elements of Crimes
The Center emphasizes that such acts may constitute serious international crimes when the necessary legal elements and jurisdictional requirements are established and may give rise to individual criminal responsibility before competent judicial authorities
DEMANDS OF AL-RAFIDAIN INTERNATIONAL CENTER
Al-Rafidain International Center for Justice and Human Rights calls upon the United Nations Human Rights Council the Office of the United Nations High Commissioner for Human Rights and the international community to take urgent action within their respective mandates and closely examine the human rights and political implications of appointing Laith Hadi Saeed Al-Khazali to a senior sovereign position in the Iraqi government
The Center further demands that the parliamentary vote or governmental appointment must not be regarded as immunity from accountability or as exoneration from allegations of grave human rights violations and calls upon international institutions to refrain from granting any political cover or international legitimacy that could obstruct independent investigations or criminal accountability
The Center calls for the immediate establishment of an independent and transparent judicial investigation into all allegations concerning abductions killings and enforced disappearances committed in Salah Al-Din Samarra Mosul and other areas of Iraq and demands that any individual against whom sufficient evidence is established be referred to the competent criminal judicial authorities

يُدين المركز الدولي الرافدين بشدة تصويت البرلمان على تعيين ليث هادي سعيد الخزعلي ويطالب بتحقيق دولي في مزاعم الاختطاف والقتل والاختفاء القسري
يُعرب المركز الدولي الرافدين للعدالة وحقوق الإنسان عن إدانته الشديدة واستنكاره لتصويت البرلمان العراقي على تعيين ليث هادي سعيد الخزعلي نائبًا لرئيس وزراء العراق رغم المزاعم الخطيرة المحيطة بدوره في انتهاكات جسيمة لحقوق الإنسان والعقوبات الأمريكية المفروضة عليه فيما يتعلق بهذه الانتهاكات
يؤكد المركز أن تعيين أفراد يواجهون مزاعم خطيرة بانتهاكات ضد المدنيين في مناصب عليا للسلطة السيادية يشكل تجاهلاً صارخًا لحقوق الضحايا وعائلات المختطفين والمختفين قسريًا ويُقوض الثقة العامة في المؤسسات الدولة وقانون الحكم
ينبه المركز إلى مزاعم خطيرة تتطلب تحقيقًا قضائيًا مستقلًا في المسؤولية المحتملة لليث الخزعلي عن جرائم الاختطاف والقتل والاختفاء القسري المزعومة التي ارتُكبت أثناء عمليات عسكرية وأمنية في محافظتي صلاح الدين ونينوى خاصة في سامراء والمسكوب بالإضافة إلى الانتهاكات الموثقة من قبل المنظمات الدولية في مناطق أخرى من العراق
يشدد المركز على الضرورة الملحة لفحص هذه المزاعم وجميع الأدلة ذات الصلة وشهادات الشهود دون تأخير وتحديد المسؤولية الجنائية الفردية بما في ذلك المسؤولية الناتجة عن الأمر أو التحريض أو المشاركة في ارتكاب الجرائم أو التسهيل فيها كلما دعمتها أدلة قانونية مقبولة
الإطار القانوني الدولي
يستند المركز في مطالبه بالتحقيق والمحاسبة إلى أحكام ميثاق روما للمحكمة الجنائية الدولية خاصة المادة 6 المتعلقة بجريمة الإبادة الجماعية والمادة 7 المتعلقة بجرائم ضد الإنسانية بما في ذلك القتل والتعذيب والاضطهاد والاختفاء القسري والمادة 8 المتعلقة بجرائم الحرب والمادة 9 المتعلقة بعناصر الجرائم
يؤكد المركز أن مثل هذه الأفعال قد تشكل جرائم دولية جسيمة عند إثبات العناصر القانونية اللازمة والمتطلبات الاختصاصية وقد تؤدي إلى مسؤولية جنائية فردية أمام السلطات القضائية المختصة
مطالب المركز الدولي الرافدين
يطالب المركز الدولي الرافدين للعدالة وحقوق الإنسان مجلس حقوق الإنسان التابع للأمم المتحدة ومكتب المفوض السامي للأمم المتحدة لحقوق الإنسان والمجتمع الدولي باتخاذ إجراءات عاجلة ضمن اختصاصاتهم الخاصة وفحص الآثار المتعلقة بحقوق الإنسان والسياسية لتعيين ليث هادي سعيد الخزعلي في منصب سيادي علي في الحكومة العراقية
كما يطالب المركز بأن لا يُعتبر تصويت البرلمان أو التعيين الحكومي حصانة من المحاسبة أو براءة من مزاعم الانتهاكات الجسيمة لحقوق الإنسان ويطالب المؤسسات الدولية بالامتناع عن منح أي غطاء سياسي أو شرعية دولية يمكن أن تعيق التحقيقات المستقلة أو المحاسبة الجنائية
يطالب المركز بإنشاء تحقيق قضائي مستقل وشفاف فوري في جميع المزاعم المتعلقة بالاختطافات والقتلات والاختفاءات القسرية المرتكبة في صلاح الدين وسامراء والمسكوب ومناطق أخرى من العراق ويطالب بإحالة أي فرد ثبتت بحقه أدلة كافية إلى السلطات القضائية الجنائية المختصة.
